The Competition Commission of India (CCI) on Thursday penalized seven companies that were said to be “directly or indirectly involved in setting prices, allotting tenders, controlling supply and market, co-biding prices”. Organizing and manipulating the bidding process.”

“The Competition Commission of India (CCI) has issued final orders against seven companies/firms found to be in contravention of the provisions of section 3(3)(a), 3(3)(b), 3(3)(c) ) and 3(3)(d) read with section 3(1) of the Competition Act, 2002 (the Act), which prohibits anti-competitive agreements,” the CCI said in a press release.

“The evidence in this case includes regular e-mail communication between the parties and filing of bids by some of the parties from the same IP address,” it said.

The CCI held 10 employees of these seven companies “responsible for the anti-competitive conduct of their respective companies/firms, in accordance with the provisions of section 48 of the Act”.

The CCI said that it has imposed a penalty of 5% of average turnover/income on companies/firms and some of their individuals found guilty of contravention of the provisions of the Act.

“However, the benefit of reduction in penalty under the provisions of section 46 of the Act of 100% was passed on to the lesser penalty applicant. After the deduction, the CCI directed the parties to pay the total fine of approx. INR 30 lakh, in addition to issuing ceasefire orders,” the regulatory body said.
